The Supreme Court of India recently, passed a judgement which is one step closer to achieving gender equality in India. The court ruled on appeal by Christian woman against the ruling of the Delhi high court and the district court by saying that an unwed mother can be a child’s guardian without the biological father’s consent.
The woman appealed to the apex court saying that the biological father of her child was married and didn’t take any interest in the child’s upbringing. thus, she shouldn’t have to consult him in matters concerning the child. The supreme court said the father’s consent was unnecessary as it would mean giving legal recognition to the man who had left the mother and showed no concern for his offspring’s welfare. The order, however, would not affect the child’s right to know the father’s identity.
